The El Paso County criminal court is the only authority that has the power to issue a warrant for detention. However, the police do have the right to arrest a person on suspicion if the officer has some reason to believe that the individual who is being detained is about to commit a crime.

Law enforcement officials also have the authority to stop and search a person on the streets if he/she is suspected of carrying illegal substances or being in possession of illegal firearms. It is estimated that if this negative trend is left unchecked, the crime rate may very well burgeon to 25,000 the next few years. Over 48 criminal reports are filed in the county everyday which equates to almost one criminal incident every 30 minutes.
